BJP dodging the appeal on Jaya is Understandable but what about the Congress ? Why the delay? Is there some political re-alignment in process ?

It looks like both the Congress and BJP have no stand when it comes to pursuing the Jayalalitha case in the Supreme Court.

Karnataka Pradesh Congress Committee’s Legal and Human Rights Cell on Tuesday kept wondering as to why the BJP is not making its stand clear on filing an appeal in the apex court. The BJP said that it is neither for or against filing an appeal.

Congress Legal Cell Chairman C M Dhananjay told reporters, “It looks like the BJP wants to politicise the issue once the Siddaramaiah government takes a decision on whether to file an appeal in the apex court or not against Jayalalitha’s acquittal.” “Instead of setting deadlines for the government to file an appeal, BJP leader Subramanian Swamy should go ahead and file one,” Dhananjay said.

Asked about the cell’s stand on the issue, Dhananjay said the government was not a party to the entire legal proceedings and had no role to play.

BJP State president Pralhad Joshi, when contacted by this paper, played it with a straight bat, saying the government must study the judgement and take an appropriate decision.

Meanwhile, senior Congress leader M V Rajashekaran has sought the government to refrain from filing an appeal in the Supreme Court challenging the acquittal of Jayalalitha.

In a letter to Siddaramaiah, Rajashekaran said it would help in strengthening relationship between the two states.
 
As this sword is hanging over many politicians, there will be consensus not to appeal if the verdict is favourable, meaning acquittal.

All Indian Anna Dravida Muunetra Kazhagam leader J Jayalalithaa has been elected by party lawmakers to take over as chief minister of Tamil Nadu at a party meeting in Chennai this morning.

The 67-year-old leader, who was not present at the meeting, is likely to take oath tomorrow.


144 of 150 party lawmakers attended the meeting at the AIADMK headquarters where five rebel MLAs from actor-politician Vijayakanth's DMDK were also present.


Current chief minister O Panneerselvam headed straight to Jayalalithaa's Poes Garden residence after the meeting. He is expected to resign today.

BENGALURU: Karnataka's ruling Congress on Friday advised its government not to appeal against the state high court verdict, acquitting AIADMK supremo J. Jayalalithaa in a corruption case.

"The role of Karnataka is administrative and not judicial. Our state is not a party in any way of the proceeding trial before the special judge or in appeal," party state unit's legal and human rights cell department chairman C.M. Dhananjaya told IANS.

The legal opinion came ahead of 67-year-old Jayalalithaa's swearing-in as the Tamil Nadu chief minister for a record fifth time on Saturday in Chennai following her unanimous election as the AIADMK's legislative party leader earlier in the day.

The high court's Justice C.R. Kumaraswamy upheld the former Tamil Nadu chief minister's appeal, quashing all charges against her and setting aside her conviction and four-year sentence given by a trial court here on September 27, 2014, in the 18-year-old disproportionate assets case.

"Our state has not participated in the judicial function. It only carried the Supreme Court orders ever since the graft case was transferred to Bengaluru in November 2002 on the ground that a fair trial was not going in a Chennai court," Dhananjaya said.

Not surprised by this decision of Karnataka Congress and that was also evident from Dr.Subramania Swamy's various tweets right from the time this verdict came .
 
As I was ruminating on the return of JJ as CM of Tamil Nadu, thought of putting my thoughts as a poem..It was my maiden attempt..I showed it to Smt Raji Ram who is a savvy poetess in Tamil...She suggested some changes...Here goes the poem!

We have to take the words of Congress "with a pinch of salt". Congress is past master in the game of deception. They know they have no political space in TN and are trying for the opportunity to see whether they will get the shoulders of AIDMK to piggy back in the next elections to TN Assembly.

Such a huge reversal of fortunes within a span of 9 months.. From almost queen like status, JJ was reduced the status of a convict and then again had the pre-conviction position bestowed upon her. The circle is not complete as yet and there may be twists and turns if some competent person or authority approaches Supreme Court.

Ordinary people do not have such fortune reversals normally. The probable reason beyond the possibility of mundane, could be:

1. God's Grace.

2. Law of Karma.

If someone agrees with these as probable cause or causes, I would like to know what is THAT which caused Grace to shower such a bounty on JJ.

If it be the Law of karma, what sort of karma entails one to such a tide of events.

In Politics anything is possible . BJP needs Jaya support badly in Rajya Sabha and hence are warming up to her . Jaya needs Congress High Command blessings to prevent the Karnataka Govt from going ahead in filing this appeal . Congress needs Jaya's support in stalling Modi both inside and outside the parliament and also some breather in TN to get back few seats . We do not know what will happen in the future and all possibilities are possible .

Depends on whether one is a Believer, skeptic or a disbeliever or a partial believer.

If one is a skeptic or a disbeliever, or even a partial believer (who believes that God is at some distance mutely watching the proceedings as a "silent witness"), THAT could be any of the conspiracy theories ranging from pre-fixed judgement to downright incompetency in basic arithmetic.

If a believer it could be God himself acting through the Judge causing him to pen down the present judgement (like Chitragupta recording all events sitting at one's back or Lord Ganesha taking down the dictation of Sage Veda VyAsA).

The cause of my curiosity is that almost all the posters in this thread had at one time or another vouched for the Bhagwad-Geeta and had quoted "karmaNye VAdhikAste" but in analysing a result, they shove it at the side and tried to find material causes.

Chennai/Bengaluru: As J Jayalalithaa took over as Chief Minister of Tamil Nadu for the fifth time today, questions continue to mount over lapses in the Karnataka High Court order acquitting her.

While reporting on some of those lapses earlier in week we had pointed out how the judgement brought down Ms Jayalalithaa's unaccounted assets by almost a third, by fixing a uniform rate of construction for a host of different properties.

The judgement had fixed Rs. 250 per square foot as the flat rate. Using this figure, the cost of properties drops from Rs. 27 crores alleged by prosecution, to only Rs. 5 crores.


This one calculation alone helped bring down her unaccounted wealth (referred to as disproportionate assets) from Rs. 66 crores, to Rs. 37 crores.

But how did the judgement arrive at this rate of Rs. 250?

The answer is buried in page 786 of the 1000-page judgement: the figure is derived from a quote given by the Public Works Department (PWD) for the average cost of construction for a sentry shed in Chennai!


The PWD submitted a cost of Rs. 310 per square foot, which the judgement further reduces to Rs. 250 per square foot, applying that rate uniformly to Ms Jayalalithaa's and Ms Sasikala's properties.

These range from farmhouses, bungalows, apartments and factories scattered across Chennai, Tamil Nadu, and even one in Hyderabad.

We personally visited two such properties, to establish how strikingly different they were: one, a printing unit in an industrial area in south Chennai (now being converted into the new offices of Jaya TV), and the second a commercial complex in upmarket central Chennai.

BV Acharya, Special Public Prosecutor in the case, says this calculation has no basis. "How can rate of sentry shed be applied to all these properties," he told NDTV. He says the calculations for the rate of construction by the investigative agency were done building to building, arriving at the figure of Rs. 27 crores.

According to newspaper reports, Karnataka's Advocate General has strongly recommended the state should appeal against Ms Jayalalithaa's acquittal, citing a number of errors in the court's order.

For the moment, Ms Jayalalithaa is back in office, thanks in part to the cost of a sentry shed.
