Will J. Jayalalithaa emerge victorious in the appeal verdict on 11th May

Finally the appeal verdict is being pronounced on 11th May...There were various rumors till yesterday doing the rounds...But there were lots of prayers for J.Jayalalithaa's success in this trial by well wishers & her party men & women...Will JJ emerge victorious in this appeal or will she become the sinned and go back to Jail...It is quite clear that if JJ is not leading the Government AIADMK will fail at the hustings in 2016 & DMK will sweep TN
 
We must not be surprised by any verdict whether it is for / against Jayalalitha . But having said the same the Odds are against Jayalalitha more if you look at the incidents that happened in the last few days with regard to removal of PP Bhavani Singh and appointment of Acharya as the new PP . Anyway Subramanya Swamy has mentioned indirectly how the results will turn in to and all other Political Parties like PMK , Tamil Nandu Congress are asserting their presence to occupy the Political space anticipating that the Jaya Verdict will be negative for her .
But as I said we must not be surprised even if the Verdict turns out in favor of Jaya .
 
Corruption is a given situation in Tamilnadu. It requires Herculean effort to change the picture and so never likely to happen..

If you are smart and keep company with people who are equally smart you can escape the clutches.

If you have a weak link somewhere in your machinery, you will be caught and the system will try to exorcise the ghost symbolically by going strongly against you. They need examples to show to the people!! LOL.

J.J's case is a pathetic one. She had weak links and they snapped. Now she is suffering.

The verdict has 50/50 probability of going against her.

If it goes in her favor she comes back victoriously and becomes the Goddess to rule for the next minimum two terms.

It it goes against her:

scenario one: She gets back on a majority riding the wave of sympathy. A woman in distress still find a sympathetic and supportive resonance in Tamil psyche. It will be again Makkal muthalvar ruling from a distance and the elected muthalvar faithfully ruling as per her wish. This has a good probability. With the opposition in poor shape and no leader in the horizon to catch the imagination of the people this may happen. And after the election the opposition parties will go with their stories of how the polling was manipulated etc.,

People will settle down to the next 5 years of dealing with corrupt politicians from the panchayat member level to the minister level and from the constable level to the higher officials level. IAS officers will forget all that they learnt in their Himalayan Academy and will carefully remove their vertebra to be kept in safe-custody at home while they are busy discharging their duties in the Secretariat.

Scenario two: She loses the election and opposition Avial comes to power. They will also rule when they get time after sorting out their periodic wranglings. And the rest will be ........please read from the above para of Senario one.

One good thing will be the amma unavakam and amma marunthakam will continue in some other name with its cheap variety rice and chapathi and paruppu kadaisal. No one will dare stop that.
 
It is always the luck? Does the Guilt proven in court of law with the prevailing rules of the land matters?
I know we all have biases but we also believe in the judiciary. Or are we so jaded with corruption that we only profess of "our values" in idle discussions, but practice contrary to the professed values.
 
While there is genuine sympathy for Jaya and that sympathy will continue even if the verdict goes against her but the big anger with the people is that the entire Government Machinery in TN has become defunct and unless Jaya sits on the CM Chair once again , the administration will not show much improvement ir-respective of how humble ,Obedient Sri Paneer Selvam is . The quality of TN Administration has reduced to such a low that even a non existant Tamil Nadu Congress is getting sufficient oxygen to take up the corruption issue and expose the AIADMK Govt and its ministers and it is due to pressure exerted by TNCCI President Illangovan that made Agri Krishnamurti loose his ministership . TN Congress along with some Anti Corruption units are planning a Ramana Movie like expousre of AIADMK Corruption . Anyway it all depends upon the verdict of Jaya to see how this will unfold in the future .
 
If she comes out successfully, she will win comfortably. If not successful but gets bail, she will canvass vigorously for success of the party. In that case, who is going to be CM candidate - OPS or Rajnikanth will be inducted to retain popularity?
 

Opposition parties look to rebuild fortunes

DMDK and PMK might seek to form new alliances for the 2016 Assembly polls.

While supporters of the ruling AIADMK are waiting with bated breath for their leader to emerge successful in her appeal in the Karnataka High Court against her conviction, Opposition parties are counting on an adverse verdict to rebuild their own fortunes.

Although the AIADMK vote bank and Ms Jayalalithaa’s hold over the organisations is unlikely to suffer any immediate setback even if the High Court concurs with the lower court, political parties such as the DMDK and the PMK might seek to form new alliances and cash in on a possible mood of gloom in the AIADMK camp.

PMK founder S. Ramadoss has been harping on an alternative front. PMK MP Anbumani Ramadoss has launched a war of words with DMK treasurer M.K. Stalin on who is better qualified to rule the State. DMDK founder Vijayakant, despite moving close to the DMK, will also seek to project himself as a right alternative.

VCK leader Thol. Thirumavalavan is talking of cobbling together a front of smaller parties. The two Left parties, pursuing a policy of equidistance from the AIADMK and DMK, might try some permutations and combinations of their own.

As said in my earlier post I am not surprised by the acquittal of Jaya by the Bangalore High Court but we have to wait for his reasons behind his judgement .
 
Most likely JJ will take oath as CM on May 17 as today/tomorrow are Ashtami/Navami..She will call for early election within the 6 months period to become MLA..As per political grapevine Assembly elections will be held in Nov...

CHENNAI: The acquittal enables a big political comeback for Jayalalithaa, who has waged many legal battles and seen several ups and downs in her political career.
Jayalalithaa is now eligible to takeover as Tamil Nadu Chief Minister with immediate effect. There are many projects riding on this verdict in the state like the inauguration of the Metro Rail project which has been much-delayed.
Post the initial verdict by Justice Michael Cunha in the sessions court, many other projects by AIADMK government like opening of 100 Amma canteens across the state and 400 new government buses await for Jayalalithaa’s inauguration.
The significant budget session and Global Investor’s meet has been postponed twice already

In another thread pertaining to ‘Salman Khan - hit-and-run case,’ one member was arguing with some amount of reasonable force/emotion :) and his stand was that if one is from North, they will not go to jail, but if one is from South they will go to jail.

He was accusing that the Government at the center is responsible for influencing the judiciary indirectly favoring the Actors/Leaders/Politicians of North, but is going against the politicians of South.

In support of his argument, he was also referring to the cases of Kalmadi, Srinivasan, Denial of bail to Jayalalitha, etc

Now Jayalalitha was acquitted from the D.A. case by the Karnataka High Court today.

Going by his own version, can be members presume that it is the desire or influence of the Government at the Centre that has played vital role in the pronouncement of this judgment too?

Or

Is it that the Law of the land prevailed.

His stand that the Government at the Centre is against the Politicians of South and is favoring the Actors/Politicians of North, still holds good?

In a stern message to the Opposition parties in Tamil Nadu, AIADMK general secretary Jayalalithaa asked her political opponents to end today any thoughts of decimating her political life, or the “great party” founded by late MGR.
Stating that the Karnataka High Court verdict gave her “immense satisfaction” as it had cleared the slur on her public life and the charges levelled against her by the Opposition, she affirmed: “The verdict proves I’m completely innocent.”
In her first statement to people after her conviction by a trial court last September, Ms. Jayalalithaa said she had always desired the well-being of the Tamils and vowed to work for their welfare always.
Acquitted of all charges in the disproportionate assets case by the special bench of Karnataka High Court on Monday, Ms. Jayalalithaa chose to remain inside her Poes Garden residence even as the cadre went into celebration mode outside her house and across the State.
While everyone was waiting for her to make a public appearance as she has confined herself in her home from the time the Supreme Court granted bail, she issued a statement through party headquarters.
“It is not a victory for me personally. Justice and dharma have triumphed. Conspiracies may win temporarily but the final victory is always for truth,” she said.
On the occasion she recalled the “sacrifices” of 233 party workers who had committed suicide from the time of her conviction, including four on Sunday, Ms. Jayalalithaa said had they been patient they might have celebrated with the rest of Tamil Nadu on Monday.
She thanked the party workers, especially women and all the people of Tamil Nadu who had prayed for her release.

Jayalalithaa’s acquittal comes as a surprise to even her party colleagues and some AIADMK lawyers, but her return to the throne is only a matter of time — less than a week, to be precise (she will have to get elected as an MLA again within six months). It may not be the end of the case, as it could go to the Supreme Court, but for the time being, it’s time for some political churning in Tamil Nadu and, as a ripple effect, at the national level. An adverse judgment would have meant the AIADMK leader being debarred from contesting an election for six years from the last day of her sentence — something which had kept several smaller parties in Tamil Nadu either silent or just murmuring incoherent criticisms of the AIADMK prima donna. Now some of them — Congress rebel and Tamil Manila Congress leader G K Vasan for one — would be cozying up to Amma. AIADMK leaders have been discussing the need for a bigger coalition in next year’s assembly election if the verdict went against Jayalalithaa. But now on a stronger wicket, whether she would want anyone as an ally is an open question.

The Karnataka High Court on Monday said that AIADMK general secretary Jayalalithaa was entitled for acquittal as the disproportionate assets (DA) held by her was less than 10 per cent of her income as per the guidelines of the Apex Court for acquitting public servants based on the quantum of DA possessed by them in the corruption cases.

The Court said that Ms. Jayalalithaa possessed DA of only Rs.2,82,36,812 while declining to accept the case of the prosecution that she had DA of RS. 66.65 crore or the DA amount of Rs. 53.6 crore arrived at by the special court.

In his 919-page verdict, Justice C.R. Kumaraswamy said that "the prosecution has mixed up assets of accused, firms and companies and also added the cost of construction i.e., Rs.27,79,88,945 and marriage expenses at Rs.6,45,04,222/- and valued the assets at Rs.66,44,73,573."

"If we remove the exaggerated value of cost of construction and marriage expenses, the assets will work out at Rs.37,59,02,466. The total income of the accused, firms and companies is Rs.34,76,65,654. Lack of proportion amount is Rs.2,82,36,812/-. The percentage of disproportionate assets is 8.12%. It is relatively small," the Court found on analysing the documents.

From the Apex Court’s verdict in Krishnanand Agnihotri’s case, the High Court said that when there is disproportionate asset to the extent of 10%, the accused are entitled for acquittal. Also the High Court took note of a circular issued by the Government of Andhra Pradesh that disproportionate asset to the extent of 20% can also be considered as a permissible limit.

Based on Krishnanand Agnihotri’s case and AP government’s circular, Justice Kumaraswamy concluded that disproportionate assets of 10% to 20% has been taken as a permissible limit in DA cases while taking into consideration the inflatory measures.

"In the instant case, the disproportionate asset is less than 10% and it is within permissible limit. Therefore, accused are entitled for acquittal. When the principal accused [Ms. Jayalalithaa] has been acquitted, the other accused, who have played a lesser role are also entitled for acquittal," Justice Kumaraswamy said.

On Ms. Jayalalithaa’s income, the High Court said that the trial court has not appreciated the evidence in a proper perspective. "Though the trial court in its judgment mentioned that the accused availed loan by the Indian Bank, but it has not considered the same as income. Therefore, the trial court has erred in not considering the loans as income…"

In this case, the trial court has ignored the Income Tax proceedings as minimum evidentiary value, the High Court said.
 
Monday's ruling means she can return as the head of Tamil Nadu government.
Jayalalitha, a former actress, is one of India's most controversial and colourful politicians. She has been a leading figure in south Indian politics for three decades.
"Truth and justice have prevailed," Ms Jayalalitha said in a statement after the court order.
"I am immensely satisfied, the verdict has paved the way for me to emerge as tested pure gold," she added.
As soon as the high court in the southern state of Karnataka announced its verdict on Monday morning, Ms Jayalalitha's supporters began celebrating outside the court in Bangalore.

'Jayalalithaa's acquittal is a bad omen for the entire country'

The Karnataka high court on Monday pronounced its verdict in the former Tamil Nadu chief minister, J Jayalalithaa’s disproportionate assets case, and she has been acquitted of all charges, trouncing the trial court judge John Michael Cunha’s September 27 judgment that sentenced her to four years imprisonment and a fine of Rs 100 crore.

Needless to say, the acquittal has come as a rude shock to all the opposition parties, especially the Dravida Munetra Kazhagam.
