Neither the law nor its hidebound interpretation makes it easy for a couple to end a marriage

Divorce needs to be liberalized!

Supreme Court advocate Indira Jaising echoes the sentiment. Divorce, she says, needs to be ‘liberalised’. “People cannot wait a lifetime for a divorce. Times are changing, and people now know that life does not begin and end with marriage.”


In September this year, the Supreme Court waived the six-month ‘waiting period,’ once compulsory for mutual consent divorces. This was seen as huge progress in a country where getting a divorce can take anything from two to 12 years. But a contested divorce continues to be a prolonged nightmare for the couple.



Counsellors and judges often try first to “save” rather than “break” matrimony, says senior advocate Sudha Ramalingam. “The judiciary is after all nothing more than a reflection of our society, where marriage is seen as a sacred union, not a legal contract.”

Divorce is a serious decision. It is not like husband wanting to buy an Audi and wife prefering a Diamond Necklace - all Blue Jacks. They stop talking till they kiss and make up in a week or two.

The six month cooling off period was the right thing in the law.

Doing away with that provision is not correct.

In the six months which is neither too long nor too short, the two involved parties can reflect on all that had happened and all that is in store. And decide deliberately.

It would be better to look at the statistics to know how many marriages were saved because of this six month interregnum. Any data?

In some of these States where rates are higher, patriarchal norms are less entrenched, women have greater workforce participation and support from their natal family — so the socio-economic penalty of divorce is lower,” says Chattopadhyay. Among the northern States, Bihar, Uttar Pradesh and Haryana had particularly low rates of marriage dissolution.
Interestingly, the ‘separated’ population in India is three times the divorced population. “Considering that divorce is likely to be reported as separation because of the stigma associated with it, the real figures for divorce are likely to be higher,” she says.
Another trend was that women reported divorce three times more than men. These numbers probably come from the fact that women — especially those with children — do not remarry as frequently as men, says Chattopadhyay.

I agree and also the male bias is there in court decisions.

All Divorce courts should have younger women judges.

When it is mutual consent divorce, as would be termed no fault, why should there be court mandated time off?
 
The boy was brought in to meet the girls family by the boys relatives....The girl was blamed by the boys relatives...The girl opened up and shared her travails in the boys family...The boys family looked sympathetic...Now the girl asked what is the boy saying..He was no where in the picture..He was standing outside the house...He was not interested in any discussion...His ego came in the way to speak to the girl whom he married a year ago...His self pride made him stand outside the house..What do we do with such psychotic characters...The boys family left without reaching any conclusion...This happens in many families because of some individuals who suffer from megalomania

You sound biased..
Why only blame the male?

Usually both have faults.

Its clear the guy cant handle stress...hence he has given an "outstanding" peformance by standing outside the house....also it shows the girl could be a nag...hence he prefers to stand out.

Its not megalomania....its just Takdir for Talaq.

A mismatched couple.

Many are mismatched.It becomes more glaring when both become senior citizens and retired.Both carry on as a matter of duty or are cannot contemplate life on their own without the spouse.In many cases most think a known angel is better than any outside.

I agree with you Sir.

Many are mismatched. The basic trouble in the Indian Society is... the girls don't get to choose. That is the case in the love marriages too. The girls mostly stay married only due to the social pressure.

But when they become older, they don't have the pressure anymore. They start actually hating their husbands. Evenif the husband was a loving spouse, looked after his wife well... it doesn't matter. The wives think they were short changed in the marriage....

Most husbands suffer depression after retirement. Some of them have the courage to end it after their retirement... N, they don't end the marriage.. mostly they end themselves....
 
No No No Nothing melodramatic like ending marriage or ending themselves.

Men make meek attempts at escaping from wife.Like my neighbour who simply vanished from home and wife got a call from him after a week that he was in hardwar and returned to be with wife again.

Again we were enraged when we saw manikandans short film Lakshmi who escapes from husband and has a rollicking affair before returning home

Life is made up of a number of short incidents with each making meek attempts to find happiness outside of marriage.lol

You mentioned ' Men make meek attempts at escaping from wife'. If it is not unbearable, why would one try to escape? I know only a minority who liked to stay together when they were old.

Most Indian men can't look after themselves. they can't even make a decent cup of hot water. They are so dependent, those men can't leave...

More than chastity it is TRUST, and RESPECT that counts in marriage.

I think trust and respect will follow if a person is chaste! :)

No one will have any respect for a spouse who goes astray!

This will never happen in my family circle because they will not see this film is நெ ருப்புக்காேழி syndrome. - Can you vouch people who are not allowed to see this film

I have just returned to forum after a long time.

Do not know what transpired earlier.

Even National TV channels are carrying the news about this film.
