A PIL urged the court to inquire into the "mushrooming of illegal businesses" of marriage brokers and marriage service providers. It also contended that advertisements on matrimonial websites seeking dowry were directly violating the provisions of the Dowry Prohibition Act and sought orders to the state government to regulate the functioning of such websites.
The court has directed all the states to implement the above order on dowry. So far as I know, this order is there on statutes and on paper safe, for long with very few people honouring it. The practice that was originally prevalent among Hindus only today has become common among the Indian Christians and Muslims too. I do not know whether it is prevalent among other religionists such as Buddhistts, Sikhs, Jains and so on. While these religionists have broken away from their parent religion, I am cock sure that this dowry habit will be followed in all its sincerity and seriousness by most of them. This practice is prevalent even among certain tribal sections. It is very difficult to define the term dowry. Only in case a complaint is lodged, action can be taken. When and where there are no complaints, what action could be taken and how? We don't have an answer. What is willingly given can be termed as a gift or a present. Those who oppose dowry at the time of their daughter's marriage are in favour of dowry when it comes to their son's marriage. Dowry among poor families is one of the causes of female faeticide. Among the middle class people, it is a give and take affair for those who are endowed with equal number of male and female children. The less fortunate are those who fight dowry tooth and nail. Unless the concept of dowry is extinguished from the minds of people, it will find its ways into the system in different names. The concept cannot easily be removed from tainted minds by law alone. The conscience of the individuals must be awake, but the temptation in many cases seems to suppress their conscience.
When it comes to marriage brokers and marriage services, how is the government going to regulate it? Will there be a separate diploma or degree course for that, qualifying which, people become eligible for providing marriage services?
Action can be taken on open advertisements, but that alone cannot stop the dowry evil. Without ads, it can survive through word of mouth. Severest punishment in proved cases where the aggrieved has complained for relief, can help to do away with this evil to some extent. Accepting dowry should become a social stigma and until this happens, this problem will be very evasive. Most of the evils about which we complain, we are only responsible. No use expecting the government to do everything.
