Justice has finally come full circle...After a 12 year trial Salman Khan who was behind the wheels when his car mowed down 5 persons sleeping on the pavement killing 1 & injuring 4, is pronounced guilty by a sessions court..He will be immediately arrested after the sentencing....Not sure if & when he will get the bail

A Mumbai sessions court has pronounced actor Salman Khan guilty in the 2202 hit-and-run case. The Bollywood superstar rammed his Land Cruiser into a Mumbai bakery in the early hours of September 28, 2002, killing 1 and injuring 4 who were asleep on the footpath.


The judgement in the over 12-year-old case, was finally given today. The case saw many twists and turns and can now mar the career of the actor on whom ride investments of over Rs 200 crore.


The actor has claimed he was not at the wheel at the time of the accident which killed one person and left four others injured on the night of September 28, 2002. While the prosecution has insisted that a drunk Khan was driving the Toyota Land Cruiser that ran over the victims sleeping on the pavement outside a bakery in suburban Bandra, the actor has claimed it was his driver Ashok Singh who was behind the wheel.


The actor has been charged under IPC sections 304 part II (culpable homicide not amounting to murder) which attracts up to 10 years in prison; 279 (rash and negligent driving) which stipulates six months jail; 337 & 338 (causing hurt by act endangering life and causing grievous hurt respectively) with punishment up to two years, and 427 (mischief causing damage to property) with maximum punishment of up to two years.

Under Motor Vehicles Act, Khan has been charged under Sections 34(a), (b) read with 181 (driving vehicle in contravention of rules) and 185 (driving at great speed after consuming alcohol).

He has also been charged under provisions of Bombay Prohibition Act relating to driving under influence of alcohol which provides for maximum six months' jail.

Footpath is not meant to sleep If you do sleep like a dog (on the foot path) you will die like a dogI suggesting they desrved to be killed by an accident - alcohol or the driver was not responsible!! Arrogant, insesitive & Strange logic!! If the victims were walking and not sleeping on the foot path - then Salman, drunk, driving at 90 Km without a license would not have hit them?

Weird logic by Farah Khan! Salman has already filed for bail & his bail application is now pending for hearing at 4 pm today in High Court! Swift action by the Khans!
 
This case has taken more than a decade to reach the verdict level.

This shows how powerful people have their own way in delaying and escaping from punishment.

As usual, one can say the law has taken its own course.

The comments by Farah Khan and Abhijit need to be condemned.

Patil was a Mumbai police constable who had been assigned as Khan’s bodyguard and was sitting beside the actor when he ran over five sleeping pedestrians, one of whom succumbed to his injuries.

On Wednesday, local television networks and social media platforms in India were abuzz with news of Bollywood actor Salman Khan's conviction and sentencing for a hit-and-run case that dates all the way back to 2002.
From nitpicking about what a five-year jail term means for one of the subcontinent's biggest entertainers, to absurd, almost offensive, commentary about the reasons and legitimacy of Mumbai's homeless sleeping on pavements, it was a strange narrative to follow.
But throughout the whole event, one thing appeared to be quite clear: That some sections of India's elite still think they should be able to get away with doing the wrong thing, even when they acknowledge fault. There is a deep-rooted culture of entitlement here, that many are still resigned to, that perpetuates and encourages this view of the world.
In a country where status, power and money still get you a long way, this approach is understandable, because, put simply, that's just how society, politics and business operate. But it also highlights just how much work needs to be done to achieve the great Indian utopia, one that leaders like Prime Minister Narendra Modi enthusiastically promise: Transparency, fairness and prosperity for all.
The ground realities of India's class system, and as a result, who fortune, politics, and the legal system often favour, seem to be a leading reason why Khan's five-year jail term caught so many people - including his own, mostly poor and middle class fans - by surprise.
For instance, had a poor or middle class Indian been driving drunk and run over six people, killing one, most people wouldn't have batted an eyelid at a five-year jail term. Apart from the fact that the case wouldn't have made headlines, many would have called for sentences to be harsher to warn other potential offenders of the dangers of driving under the influence and the importance of road safety.
Anyone you speak to in India can rattle off a list of cases involving high profile people: From politicians to celebrities and a plethora of wealthy and well-connected people in between. They'll just as quickly tell you they suspect the accused will never be held accountable for what they may have done because they're important and can pay their way out of trouble. Many will wrap up by saying, "But if I had done that ..."
The underlying issue India struggles to deal with in cases like these, is not crime itself but rather, who commits it. This, as we saw again, still determines the outcome and the outburst that follows.

What?

Its not cold blooded murder.

There was no intention to kill a person here.

Its not premeditated.

In this case he was driving recklessly under the influence of alcohol that led to his car going over the pavement and caused the death to a person sleeping on the pavement. So his sentence will be for reckless driving under influence..that led to the death of a person.

This can happen to any one of us in different ways too...for example just imagine a person fights with his wife and drives on the road angrily and speeds and loses control of the car and accidentally causes the death of someone?

So many people use their handphone and text and drive..they too could lose control of their car and cause death of someone.

So I feel instead of rejoicing that Salman got screwed this time..its better we all learn to drive slowly..safely..dont text or answer calls while driving and not to drive when we angry.

I agree.

Though I believe travel by a car is a more pleasurable thing, I also believe that it is a 'killing machine' unless you handle it carefully.

Let all those who drive car be responsible while driving, both for their own safety and for the safety of other road users.

Now, let us wait and hope law will take its own course.

Vgane Ji - yes, it is a North/South issue at play here again.

Why would anyone in this country campaign for Rajapakse?, when the entire Tamil community is pushing for UN sanctioned investigation against the war crimes committed by him? This has been in the national news so many times in the last 5+ yrs…

It is only to curry favor with the center & get convenient bail despite huge negative public opinion against it.

Now you will see Jaya going to Jail. The same media will spin some other story & say you cannot link Jaya case with Salman, blah blah blah,….. etc…

See, the new govt has yet to learn how to play the media & hence the people like the previous congress..

So if one is from North, they will not go to Jail even for murders, but if one is from South, they will go to Jail even without FIR being filed like in the case of Kanimozhi, Raja, Jagan, Yeddyurappa &Kalmadi… etc…

But I think, the new govt has overplayed itself by fixing Jaya’s case so close to Salman, now people will openly question if she goes to Jail, while a thug like Salman indulged in irresponsible drunk driving & killed poor people on the road !!!
 
Renuka Ji - In your great west, drunk driving & killing people on road will instantly face Jail term, license cancelled, etc... So bail for Salman is not justified... not to mention, he deliberately delayed the trail, the witnesses passed away during this time, brought a unknown driver at the last minute to confess exactly like in an Indian movie... Not only should he be jailed, they should have increased the Jail term for subverting the process of law !!!!

Not to forget people from North got their "cases dismissed" with CBI withdrawing the cases for murder, communal riots, encounter killing, etc... while people from South are going to Jail & bail denied even before the FIR's are filed... Here even after conviction, Salman gets bail the same day, same hour.... even before he is handcuffed by police...

Sahara Roy was literally forced by millions of investors who lost heavily, to be in Jail. The courts had no choice with so much public pressure put on them. Even then, he dodged Jail for a long time…

Tarun Tejpal is a case of political vendetta & revenge, he was blatantly using his magazine to go after some politicians, &at the same time ignoring those he favored… By the way, he is out on bail, so lets wait if a conviction will ever happen….

Sanjay Dutt case went on for 20 yrs, he got bail many many times & now even when he is Jail, he is out on furlough most of thetimes… so he is hardly serving his sentence…

Again all these people from North are small fries compared to the top politicians from South who went to Jail...
