Promise of Swiss bank list

Zurich/New Delhi, June 22
(PTI): Switzerland has said it is readying a list of Indians suspected to have unaccounted money in Swiss banks and sharing it with New Delhi, which is trying to trace black money stashed abroad by its citizens.

A special investigation team (SIT) the Centre has formed has promised action if the suspects on the list are indeed found to have hidden black money in their accounts.

At the heart of the matter lies a petition veteran lawyer Ram Jethmalani had moved in the Supreme Court in 2011, asking that the Centre be forced to reveal details of an allegedly Rs 70,000 crore worth of black money stashed in foreign banks by Indians.

A senior Swiss official said the names of certain Indian individuals and entities had come under the Swiss authorities’ scanner during a continuing exercise to identify the real beneficiary owners of funds held in various banks in the Alpine nation.

He said the list of these people and entities was being shared with India, while further details would be provided in due course. All necessary administrative assistance would be made available, he added.

The Swiss government official refused to reveal any identities or the sums involved, citing a confidentiality clause in the information-exchange framework between India and Switzerland.

He, however, said the entities and individuals were suspected to have held untaxed money in Swiss banks through structures such as trusts, domiciliary companies and other legal entities based out of countries other than India.

These entities’ Indian links came to the fore after the banks and regulatory authorities made inquiries about the sources of the funds and the beneficiary ownerships of such accounts.

Justice (retired) M.B. Shah, a former Supreme Court judge who heads the SIT, said the list would be verified and action taken against those found to have kept unaccounted money.

“It is not a list of only black money. It is a list of those persons who are also legally vested. It is a combined list. We are asking for the list of the said persons. Then we will verify. Then action is taken,” he said.

Two months ago, the UPA government had placed before the apex court a list of 26 Indians who it said held money in a bank in the European country of Liechtenstein. It had revealed only 18 names on the ground that no evidence of tax evasion had been found against the other eight.

“I’m very happy today,” Jethmalani said from London. “I’m hopeful that the NDA government will take the fullest possible advantage of this information.”

BJP spokesperson Siddharth Nath Singh said: “It just shows the Narendra Modi government took a brave decision to form the SIT, which was pending since 2011.”

Aam Aadmi Party leader and senior lawyer Prashant Bhushan said the SIT had been formed on the apex court’s orders, so the government cannot claim credit for this.

Data published by Switzerland’s central bank show that Indian money in the various Swiss banks rose by 43 per cent during 2013 to close at Rs 14,000 crore. This includes the money held by Indian clients directly as well as the funds that they hold through fiduciaries or wealth managers.
The Swiss official said all this money might not necessarily be illicit.

PJ Sir,

Yesterday I read an Article published in Tamil 'The Hindu'. The author opined that fortunately if we get the black money from the Swiss Bank by proper means, half of that amount so got would be sufficient to connect all the rivers in India together so that we can see a fertile India in the years to come. Is it so?

The Swiss Bank list would be a small portion just 2% (USD 2 Billion out of USD 2 Trillion) of the total Black money..In case we are able to get details of the entire list and act upon it, it will be milk and honey every where..But even if we are able to take action on this 2% it will make a huge impact on the country's psyche!

How to bring the mony? it will be a herculean task. Swamy's suggestion is to nationalize all the black mony - unaccounted and untaxed. Then individuals can claim the amount after proving ownership and paying due taxes and fine.

In sixties the government appropriated a large area of land as govt property. We got our share of the land after a protracted legal action of over 30 years, despite having 'valid' deeds. Less than 20% of the claimants got the land back, as the rest were bogus or had no documents. A fast procedure to identify genuine owners of the swiss or any other account will help in fast recovery.

India, Switzerland deny sharing 'black money' details – Business Standard

Switzerland
has not shared any information or given assurance on sharing details about Indian account holders in Swiss banks, where a major portion of India's "black money" is suspected to be stashed, governments of both countries said Monday.

"We have not received any official communication from Swiss authorities so far about sharing bank account details of Indians (who have) deposited unaccounted money there," India's Finance Minister Arun Jaitley told reporters outside his North Block office here.

The finance minister was reacting on a media report that said Swiss authorities have prepared a list of names of Indian account holders and will share it with the Indian government.
Jaitley said there is no official communication so far, and the Indian authorities will send a request to Swiss authorities for sharing the information.

"Our communication will be sent today itself," Jaitley said.

The Switzerland government also rubbished the report.

"Since a high-level Swiss delegation met with its India counterparts in New Delhi in February 2014, no further official meeting has taken place. There is no new development to be reported," the Swiss finance ministry said in a statement

Aren't you guys counting chicken before it is hatched? Let the black money come back to India, then only we can use it.

More likely this news is a plant. The news was released on a sundsay by an unknown swiss bank official. No list prepared by swiss bank and denied by both India and swiss. Mischief mongers like kejri who waved a list when he was at his peak in shouting.

he Swiss government on Monday denied outright that it is preparing a list of suspected Indian tax evaders or had plans to prepare one to be given to India.

“It is completely wrong. There is no list,” Swiss spokesman Mario Tuor, from the department handling international financial affairs, told this newspaper over the phone from Bern.

A news agency report, widely reported in the media, had quoted unnamed Swiss government officials claiming that it has prepared a list of Indians suspected to have stashed black money in Swiss banks, and that details of this would be shared with the Indian government.

According to several sources and trends available from recent investigations, Switzerland may not any more be among the most preferred tax havens to hide ill-gotten money, or money on which the rich doesn't want to pay any tax in India.

The latest trend is of preferring tax havens closer home to the classic European tax havens that have captured public imagination. Among the new favourite destinations are Singapore, Dubai, Mauritius, and Hong Kong, say government sources and private individuals aware of such movements.

Swiss denial of black money list a setback, but we won’t stop: Justice Shah-The Hindu

‘As of now, even if a team is sent there, we can’t do anything’

Justice M.B. Shah, Chairman of the Special Investigation Team on black money, termed the Switzerland government’s denial to have shared or assured information on Indians having unaccounted money in Swiss banks a “setback”, but said the hitch would not dampen the resolve of his team.

“No doubt, this is indeed a setback for us. But we will not stop working. We will continue to pursue our objectives as SIT,” Justice Shah told The Hindu on Tuesday over the phone.

Asked whether the SIT would consider taking the investigation right up to the Swiss doors by sending a probe team, Justice Shah said, “As of now, even if a team is sent there, we cannot do anything if that country is unwilling to co-operate.”

On Sunday, a PTI story quoted a Swiss official saying the European nation had prepared a list of Indians suspected to have stashed away un-taxed wealth in Swiss banks and was willing to share it with the Indian government.
