US firm paid USD 976,000 bribe to win Indian water project

From Lalit K Jha Washington, Jul 18: A New Jersey-based construction management firm has been charged with bribing Indian officials several crores of rupees to win two major water developmental projects in Goa and in Guwahati. The bribery of USD 976,630 for a Goa project by Louis Berger included that to a minister, the details of which have not been disclosed by the Department of Justice. Yesterday, the company agreed to pay USD 17.1 million criminal fine to resolve charges that it bribed officials in India, Indonesia, Vietnam and Kuwait to secure government construction management contracts.

Two of its former executives - Richard Hirsch (61) of Philippines, and James McClung (59) of the UAE - pleaded guilty to the bribery charges. McClung previously served as senior vice president responsible for the firm's operations in India and in Vietnam. Sentencing hearings for Hirsch and McClung are scheduled for November 5, 2015.

The Indian government, assisted by Japanese government, initiated the five-year Goa Water Supply and Sewerage Project to expand, rehabilitate and build water and sewerage facilities. Louis Berger was part of a consortium for the project in Goa. The consortium included two Japanese firms and an Indian partner.

As per the existing Prevention of Corruption Act and IPC, accepting bribe is also a punishable offence.

But there is another type of bribe giver who forces the authority to bend rules or change cotract clauses for his benefit. System checks should cover all these aspects.

On line eauction for spectrum and coal has virtually eliminated one kind of corruption. Applying for certificates and documents online, doing away attestation, and time bound response - these have helped in reducing bribing at lower levels. Each process must be studied for remedial action.

Why US authorities/court are not revealing the names?

Once I was selected in TNPSC Group II services, got postings as Sub-Registrar in Registration Dept. I could not adjust myself to fit in the corruptive environment and resigned the job and joined some other job. My friends used to remind me often THE TRUTH (that I am a fool). Had I continued there, certainly I would have got corrupted.
I am a person of the old thought that corruption is not only a taboo but also prostitution of mind. Bribe is obtained for selling integrity. Prostitution of body is a lesser evil compared to this prostitution of mind.

If it happened to be a congress wala you will jump with joy.
People like you never really want to solve the problem, and just want to point fingers at others. When corruption is pointed out in saffron-wala you are the first one to prop them and blame on others. You bat for every Saffron wala, even if was a serial killer.
Why did you not release the names of all black money holders? What have done to reduce corruption? Where is the Ache DIn?

Goa CM to seek CBI probe in bribery by US firm for water project

"Since it is an international matter, Goa police can't investigate it. That is why the government has decided to write to Prime Minister and Union Home Minister demanding a CBI inquiry into it. Truth should be revealed to the people," the Chief Minister told reporters here this morning.

"When the contracts were awarded, Congress leader Digambar Kamat was the Chief Minister and Churchill Alemao was Public Works Department Minister. Now it should be revealed which minister took the bribe," Parsekar said.
