In a groundbreaking case, the Supreme Court on Wednesday held for the first time that religious employees of a church cannot sue for employment discrimination.

But the court's unanimous decision in a case from Michigan did not specify the distinction between a secular employee, who can take advantage of the government's protection from discrimination and retaliation, and a religious employee, who can't.

There is a saying: the law is an ass.

That said, it probably makes sense if a Christian church does not want to employ a Muslim or if the Puri Jagannath temple refuses to employ a Jew.

This is a very narrow judgement and exempts the religious organizations on discrimination on hiring/firing only for those who perform religious activities.

Even then, the court did not include protection for any other abuses.

This decision is based on the constitutional requirement that the government can not interfere in the religious activities.

In our country, so far as the Hindus are concerned, there are legislation like: 'The Hindu Religious and Charitable Endowments Act' and the like (including the Rules framed thereunder) that do enable the State to regulate the activities of Hindu temples, the management of their properties and collections, and even who can perform the prayers and in what language they will be performed and so forth.
