The Real Instinct Lurking Behind the Kathua Horror

The rapes at Unnao and Kathua have shaken most of us. And yet it needs to be said thatthe Kathua rape falls in an entirely different category. The abduction, brutalisation, multiple rape and finally murder of the eight-year-old girl was an act of communal or ethnic ‘cleansing’. It was done with an intent to ridKathua of the presence of the Muslim Bakarwal community. That it was done on “behalf of the nation” was clear when we saw the tiranga being waved to cover the crime, led by people who are known as officers of the court.

Rapes of children in this country are not a rarity. We have heard of even eight-month-old babies being brutalised by men. So it is not the age of the victim alone that should shake us. Nor indeed the manner of the rape. Humans have the capacity to imagine novel depravities. Newer forms of horrors can be and have been invented and executed.

Apart from the act itself, it is the brazen and cunning support for the criminals which was displayed on the streets of Jammu under the cover of the national flag which should lead us to pause and question how as a society we have reached this point. The lawyers proved that the rapists were not alone in this ritual of the rape and murder of a little Muslim girl. I know some people will object to my describing the girl as Muslim. Let us call her a child and the rapists merely as rapists. But was she not raped and killed for being a Muslim? Was it not done to scare all the Bakarwal (Muslims) families away from Kathua?

It was the tri-colour dance on the streets of Jammu which was the most disgusting. But that should not have surprised us either. Look at the cunning calculations that lay behind what the lawyers were asking for: besides demanding the caseto be transferred to the CBI from the crime branch of the police of the Jammu and Kashmir, they also demanded that Rohingyas be evicted from the area and that the policy regarding the use of tribal land be scrapped.

All three demands have a common element: demonisation of Muslims. The cleverness behind the demand of a CBI investigation cannot be missed.

The eight-year-old child in Kathua is only an addition in the long list of girls and women who have been raped, brutalised and killed for being Muslim. This fact should not be blurred. She was not raped and killed because she was a child. The fact of the rape is important but more important than that is the politics behind this rape and murder. So it is not merely the manner and method employed to crush a fragile life that we need to discuss. That is what we see the media doing. There is a perverse pleasure in doing that. Let us not allow ourselves to be swallowed by that.

Let us not restrict ourselves to the demand of justice for the victim. She is beyond that. It is now time for the people of the country to decide how long they will remain under the spell of fake nationalists.

Hundreds of people took to the streets in multiple cities across India to protest against the Modi government’s lack of action against accused in gang rape of an eight-year-old girl in Kathua, Jammu and Kashmir and of a minor girl in Unnao, Uttar Pradesh.

Despite the level of brutality in both cases, BJP leaders have either unambiguously stood in defence of the accused or have gone out of their way to evade questions.

After facing flak for his silence, PM Narendra Modi on Friday said, “The incidents of the recent days are a challenge to social justice. The incidents which have been in public discussion the past two days would be considered shameful by any civilised society. As a society and as a country we should feel ashamed.”

Curiously, Modi refrained from referring to Kathua or Unnao by name, adding that such incidents are an attack on human values regardless of the state or area they have occurred. In Kathua, policemen that were supposed to be investigating the case stand implicated, while a politician from the ruling BJP is the main accused in Unnao.

“The incidents of the recent days are a challenge to social justice. The incidents which have been in public discussion the past two days would be considered shameful by any civilised society. As a society and as a country we should feel ashamed,” he added.

“Silence is no longer an option. If we do not speak today, those who spread hatred, those who want to break the country, those who want to destroy the Constitution, will win. We cannot let them win. For if they win, we lose our country. If they win, we lose our dream of an India that promised equality, liberty and fraternity to all its citizens,” read the pamphlet circulated by the ‘Not in My Name’ organisers.

Holding him responsible for the “terrifying state of affairs”, 49 retired civil servants, in an open letter on Sunday, urged Prime Minister Narendra Modi to reach out to families of Kathua and Unnao rape victims to “seek their forgiveness”.

“Given your supremacy within the party and the centralised control you and your party president exercise, you more than anyone else have to be held responsible for this terrifying state of affairs … We have had enough of these belated remonstrations and promises to bring justice when the communal cauldron is forever kept boiling by forces nested within the Sangh Parivar,” they added.

If Kumbakarna was awake when Sita was held captive in Lanka, he too would have posted on his facebook like Abhishek.
Just to cover their tracks. Maybe Ravana should have invoked a United Nation inquiry and called for a ceasefire. Till the investigation is complete.
Which might have taken few more years.

The time for action is now when the Governing party is involved in etheric cleansing, that is genocide.

There is a widespread protest in the country, I am surprised that we do not have outrage at this atrocity in this site.
What right we have of talking about spirituality when there is no humanity?

Filmmaker Rahul Roy, who too participated in the protest, said: "As a country we have to hang our heads in shame for having failed the Constitution. We have to acknowledge that as a country we have failed our minorities, Dalits, Adivasis, women and girls.

It’s just as well that Prime Minister Narendra Modi has lent his voice to growing outrage across the country at the horrendous violence against girls in Kathua and Unnao. His promise that justice will be delivered should be followed by stringent action against all criminals involved, including those responsible for obstructing justice – else the government’s ‘beti bachao’ slogan will ring utterly hollow. Public outrage at the crimes in Kathua and Unnao resembles the one that erupted after the 2012 Nirbhaya case, which was supposed to have been followed by course correction in the justice system. Clearly, that hope stands dispelled today.

The Unnao rape survivor faced more trauma after her father’s death in custody, her family’s exodus from their native village, and the UP police’s failure to arrest the accused BJP MLA until the Allahabad high court and CBI stepped in. In Kathua, J&K crime branch was hampered by raging protests by a Hindu Ekta Dal aided by local politicians. Both cases reflect political pressures that disrupt criminal investigations. The Nirbhaya protests were followed by a sweeping legislative response through amending rape laws. A similar trajectory is playing out again with ministers demanding death penalty for child rapists, a dangerous move giving perverse incentive to murder victims.

Parliament and assemblies have legislated for decades, but enough laws already exist to prosecute heinous crimes. The failure lies elsewhere: in registering crimes, launching serious prosecutions and delivering convictions. A related problem is political interference. Legislative changes at this point would be just a ploy by the political class to deflect public outrage. Meanwhile, police reforms enjoined by the Supreme Court have been hanging fire for more than a decade. Insulating police from political controls that influence promotions and transfers, recruiting more women cops and deploying them in special cells that investigate sexual offences, protecting witnesses, and improving forensic techniques are just some systemic reforms that are needed.

No single word defied the last term of Congress rule before 2014 than the word bhrashtachar literally ‘corrupt-behaviour’ (bhrasht-aachar) aka corruption. To define PM Narendra Modi’s rule since 2014, we have to invent a new, similar word – BHAKTACHAR, literally ‘behaviour of devotes’.

Bhakt, meaning a religious devotee, acquired political currency since 2013 to denote blind followers of Narendra Modi and/or RSS and their Hindutva brand of ideology. By extension Bhaktachar should mean action of these devotees. However, in the current political climate, it has begun to carry a deeper, sinister meaning.

It is time India stood up like they did after the Nirbhaya rape in 2012. It is time every Indian hits out against the violence, the impunity of Bhakts and their Bhaktachar. Because what we are defending are not just minorities, not just our children or women, or our vulnerable lot… we rise to protect, defend the very soul, the very idea of India, Bharat, Hindustan.

All the rant about Ramayana is unnecessary.

One has to be be outraged at the right perpetrators. All the people I know are outraged. This is not the case of Hindu or Muslim or whatever though some may want to make it that way. No human being I know can condone a death of 8 year old like this. No religion I know teaches to commit such a crime.

The right criminals have to be punished fully and quickly. If there is an opposing view that needs to be examined in the interest of justice. One should not let one's prejudices come in the way of seeking justice.

This is not the time to do grandstanding at the expense of a tragedy like this. Or advance one's political bias using the opportunity of a tragedy.

The Government I hope will find the right criminals and bring them to justice quickly. No legitimate government will let true criminals escape.

Let us not lecture other members - People have their own way to express their outrage. Some may not want to engage with some people here - that is a possibility too

Rant!!!!!

I am tired of differing action for years. Will we ever know in fact (with 100%) accuracy as to what happened?

The powerful accused with all the connection, will they ever admit to the crime?

I think India should get CBI involved right away to get to the bottom of what is going on. Cannot hang someone based on media reports. Facts have to be sorted out by CBI so that the real culprits are hanged even if they are powerful. This should not be used to turn into a religion based fights because no sane person of any religion will condone such a horrific crime . Cannot think why someone would do this crime as alleged in a temple hall. So it is all fishy.

It’s hard to pick what’s most sickening, the crime itself or the nature of support the alleged perpetrators have received. While many Indians have taken to the streets, Facebook, and Twitter to express shock, grief, and fury over the situation, not everyone is on the same page.

Back in February, over 5,000 people affiliated to a local Hindu nationalist group marched, waving the Indian Tricolour, to protest the arrest of special police officer Deepak Khajuria. The protesters claimed that Khajuria, one of the accused in the case, had been framed. They were joined by ministers in the J&K government, who are also members of India’s ruling Hindu nationalist Bhartiya Janta Party (BJP).

Since then, the backers of the accused have been seen and heard invoking religion and nationalism, raising slogans like Bharat mata ki jai (Hail Mother India) and Jai Shri Ram (Hail Ram). To add to the noxious atmosphere, even a section of lawyers in the deeply polarised state has vociferously come out in support of the accused—last week, they tried to stop the police from filing charges in a local court. The case has sparked some incredibly depraved responses on social media, too.

The outrage has now even prompted the United Nations to take note.

But it’s clear that as primitive undercurrents increasingly shape political and social life in India, an innocent child has been tragically caught in the crossfire.

If the police will not even record an FIR, how do you get CBI is brought in?
Why were the culprits not arrested with a non-bailable warrant?
And then you can investigate.

We should not carry our religious biases to crimes.

Agreed that biases have no place in an investigation of a serious and horrible crime.
CBI is like FBI -with public outcry investigation by CBI can start with the local police as to why certain things were not done. We should be all for search for the truly guilty.

Someone sent this to me about the fault lines and apprehensions.

For months, few people outside the state of Jammu and Kashmir noticed that an eight-year-old child from a Muslim Gujjar-Bakarwal family had been kidnapped, held captive, starved, raped and murdered in Kathua district. Then in April, with the spectacle of lawyers blockading the Kathua district court to prevent the police from filing a 15-page chargesheet with harrowing details of the crime, the case erupted into the consciousness of people nationwide.

This variegated politics, these local inflections do not always fit into the narratives imposed by television studios and urban centres. But if crimes like the one in Kathua are to be addressed beyond the rhetoric of public rallies, they need to be acknowledged.

Prime Minister Narendra Modi of India tweets frequently and considers himself a talented orator. Yet he loses his voice when it comes to speaking out about the dangers faced by women and minorities who are frequent targets of the nationalist and communal forces that are part of the base of his Bharatiya Janata Party.

Indians took to the streets during the weekend to protest their government’s callous response to the horrifying rape and murder of an 8-year-old girl in January in which supporters of his political party have been implicated. Mr. Modi, though, has barely spoken about this crime and other cases involving his supporters.

Until last week, he declined to address the attack on the girl, in the northern state of Jammu and Kashmir, by men who wanted to frighten and drive away her nomadic Muslim community, the Bakarwals, from an area that is dominated by Hindus. To read about what happened to the girl, who was held and abused at a Hindu temple, over several days is to plumb the depths of human depravity.

The prime minister has a duty to safeguard and fight for all of the people of India, not just those who are allied with him politically.

India’s prime minister Narendra Modi spoke in London Wednesday night in connection with the Kathua and Unnao rape horrors without mentioning either by name, saying nothing could be worse than the rape of a girl child and this is not the time compare metrics on rape cases between two governments.

"When a child is raped, what could be worse? Is that the time to compare metrics versus the earlier governments? When a girl comes home late, all parents are worried. When a boy goes out and comes home late, why don't we ask him where he was? We must make our men accountable. Look...I have lived the life of a poor man, I don't need to learn about it from a book and I know how tough that life is. Nothing is more important to me than to make our country safer, cleaner....", Modi told a massive crowd assembled for his #BharatKiBaat address in London's Westminster Central Hall Wednesday night.
