Which is Supreme..? The custom follwed by a particular temple..[ may be as per Agama Satra followed by that temple]..or the Constitutional Rights..?

Taking a swipe at religious customs and temple entry restrictions violating women's constitutional rights, the Supreme Court on Monday said no temple or governing body can bar a woman from entering the famous Sabarimala shrine in Kerala where lakhs of devotees throng annually to worship.
“Why can you not let a woman enter? On what basis are you prohibiting women entry... What is your logic? Women may or may not want to go (to worship at Sabarimala), but that is her personal choice,” Justice Dipak Misra, who headed a three-judge Special Bench, pulled up the Travancore Devaswom Board, which manages the shrine.


When the Devaswom Board countered that the prohibition was based on custom followed for the past half century, Justice Misra lashed back, asking what proof the Board had to show that women did not enter the sanctum sanctorum over 1500 years ago.
Justice Misra orally observed that the Constitution rejects discrimination on the basis of age, gender and caste. “Unless you have a constitutional right to prohibit women entry, you cannot prevent them from worshipping at the shrine. There is a difference between a temple meant for the public to worship and a mutt,” the Bench said.
The court then asked Kerala government to file a fresh affidavit in a week's time while posting the case for hearing on January 18.
The Bench was hearing a petition filed by the Indian Young Lawyers Association and five women lawyers seeking a direction to allow entry of women into the Sabarimala Ayyappa temple without age restriction. Women in the age group 10-50 are not allowed entry. The apex court had issued notice in the case way back in 2006.
The petition had contended that women, aged between 10 and 50, touching the idol was considered an act of desecration. An attempt was made to prosecute Kannada actor Jaimala on the plea of desecration following her disclosure that she entered the sanctum sanctorum and touched the idol in 1987. The priests conducted a special ritual to purify the idol.
The ban was enforced under Rule 3 (b) of the Kerala Hindu Places of Public Worship (Authorisation of Entry) Rules, 1965 (women at such time during which they are not by custom and usage allowed to enter a place of public worship). The Kerala High Court had upheld the ban in 1991 and directed the Devaswom Board to implement it.
The petition contended that discrimination in matters of entry into temples was neither a ritual nor ceremony associated with Hindu religion. Such discrimination was totally anti-Hindu. The religious denomination could only restrict entry into the sanctum sanctorum and could not ban entry into the temple, making a discrimination on the basis of sex.
It had sought quashing of the Rule contending that the ban was violative of Articles 14 (equality before law), 25 and 26 (freedom of religion) of the Constitution. They wanted guidelines laid down in matters of gender inequality in religious practices at places of worship.

The practice of ban on women entering the shrine at Sabrimala emanates from age old customs and practices.
Later this practice got codified under the Rule 3 (b) of the Kerala Hindu Places of Public Worship (Authorisation of Entry) Rules, 1965.
This was strengthened by Kerala High Court’s decision upholding the ban in 1991 and giving sanction to Devaswom Board of Kerala to implement it.
Now people have approached the SUPREME Court and the erstwhile decision of Kerala High Court, is now, put to test.
 
Some women have the habit of NOT disclosing about their monthly periods and enter temples. Hence the age limit

was set for women. It may need a change because I find girls becoming 'mature' even at the age of 9; and some women

have their menopause only after they hit 55!! :)
 
I think let the SC focus on the piled up corruption & perjury cases instead of interfering in age old traditions in one temple!

its hard to follow...court and religion are 2 different paths.....court has to follow constitutional obligations/rights.....but

religion is based on tradition and cultures...here clash between 2 different edges....i dont know....who will succeed?,,,,
 
Vinasa kale, Vipareetha Buddhi. There may be a ploy to divert attention from other activities that are going on in the country. May be publicity mongers / activists from other religion / political outfits trying to usurp the huge financial flow from the shrine. It may be anything and everything. But our SC poking their nose in religious matters, on the other hand turning away from MPs and parliament saying parliament is supreme than SC all these indicates that one day our parliament and SC may be ordered to be sanctified and worshipped instead of present temples and gods. So from now on let us start preparing the slokas and mantras for these like.. supreme courtaya namaha, parliamentaya namaha, mantriyaya namaha, judgeyaya namaha etc.
 
Frankly gender inequality should be done away with in all religions , why hindus alone.?

What is provided for in religion suited the times when those religions came into being and have nothing to do with present day realities.

Times have changed and religeous practices have to keep in pace with new realities.

Else religion will ease to attract humans

Slowly the temple or church going people are reducing in numbers .

It is a matter of time that the agnostics will out number the worshippers.

Already many of younger generation have given up on most rituals and are putting up with it .

Any abhorrent practice demeaning half of human race cannot continue . Our judges are right in their judgement and should extend it to all religions in india covering

all of indian population.It should not cover a particular temple or religion.

As far as I observe, there is an increase in the number of people visiting the temples! :bump2:
the number of people as a percentage of total population of hindus may be less.

many in younger age group are losing faith in rituals and temple going for prayers.

The fact remains that off late younger groups do visit temples with lot of hope and prayers.

Just for example let this member visit ‘ Visa’ Balaji Temple at Chilkur Hyderabad, where he can see devotees most of whom will be between the age group 25 to 30. Everyday one can see plenty of anxious youth doing pradatchinams 108 times for fulfilment of their prayers which includes
blessings for an easy visa approval process.

Just simply sitting before a system and typing some senseless texts which are quite contrary to facts, will not hold any water especially in this Forum.

'Visa God' near Hyderabad is getting busier by the day -

After they write their exams we get so many students who pray for their visa here. Sometimes, we get close to a thousand people on one day itself," says one of the coconut vendors, who sits by the entrance of the temple.

The temple does not accept any money in the form of tickets for puja or darshan and does not have a hundi. The only money it earns is in the form of parking tickets at Rs 10 per vehicle, it does not even have a hundi.

"The majority of the devotees are in the age group of 25 to 35 and the prayers are all visa related," says one of the officials with the trust fund of the temple, adding that a large majority of students get their visa after praying to the deity.

The way hyderabadis are getting deported from US even after visas shows their praying to visa God was of no use for going to US for studies. They should pray to

another God for clearance by Inland security in US.

It is a different issue.

The issue is about youth visiting temple. Don't stray from main topic.

It is not about youth entering temple .

It is about barring women from entering sabarimala temple.

You are totally confused about gender equality.

All irrespective of gender should be free to enter any place of worship.

Do you mind if women enter sabarimala temple or garland shani at a temple in maharashtra?

Your opinion anyway does not matter much and is of academic value.

Supreme court has overruled the temple trustees of kerala temple and devaswom board and their archaic diktats.

I hope wisdom dawns on these religeous fanatics .

Who should this status be disclosed to? Also is any other bodily function disclosed by anybody?

And finally as a woman, are you for or against woman being banned from this temple? Has the female ban got anything to do with the abstinence period men are supposed to follow before visiting the temple?

yes ..i agreed...see in thirupathi...ppl still wait for more than 12 hours for darshan sometimes.....all temples jam packed many festival days...

infact increasing in numbers...not decreasing....

This member who comes here to preach about gender equality, should first approach the Court to enforce gender equality practiced in Capital city.

There is a board forbidding women to enter in to prayer hall is kept at the place of worship of other religion. It is also in our rape capital where this member live.

This member who habitually wander in dreamland, tend to close his eyes to whatever happening around him, and just come here to vomit his blabbering.

What will be his reaction? Why no gender equality practiced at Delhi??

It is easy to write lenghty postings without substance.

Its so much easier being a Cow than a woman in India.

Women in delhi stand up for their rights and bring the capital to a standstill if anything untoward happens.

Rape of one Nirbhaya succeeded in amendments to laws on juvenile raping women.

Places where women stand up and take a potshot will silence the religeous crowd practising discrimination in temples.

An activist supreme court is showing the way where lawmakers have failed.

Religion has to yield to new realities of gender equality.

One cannot say that mine is a bachelor God and those in 10-50 yrs should not enter it.

Those religeous boards which frame such diktats would have to yield.

A high court judge tried to keep away from the issue of gender discrimination in muslim dargah in mumbai.

I hope some activist will appeal to supreme court.

In delhi , women are more equal than their counter parts elsewhere.
