Flight delay compensation 'open to millions of passengers'

Airlines face paying hefty compensation to millions of passengers whose flights were delayed after their appeals were rejected by judges in a landmark hearing.



The Supreme Court’s decision will allow passengers to claim up to six years after a delayed flight, and will force airlines to pay out even when aircraft are held back due to routine mechanical or electrical problems.

Lawyers representing two passengers in separate flight delay cases said the ruling on flights affected by technical faults would open the door to more than two million compensation claims every year in the UK, worth an estimated £876 million.





The decision to allow claims to be made up to six years after the event will also open airlines to historic claims from passengers dating back to 2008, which could be worth another £4 billion, it was claimed.



Passengers are entitled to up to £470 (€600) compensation, depending on the length of the flight, plus expenses when their arrival is delayed by more than three hours and the cause of the disruption is within the carrier’s control.

However, there were warnings the ruling could ultimately raise the cost of air travel by making budget airlines' pricing models unsustainable.
