பேஸ்புக்' சமூகதளத்தில், தன்னுடைய புகைப்படம் ஆபாசமாக மார்பிங் செய்யப்பட்டு, போலியான பெயரில் இடம்பெற்றதால், சேலத்தைச் சேர்ந்த ஒரு இளம்பெண் தற்கொலை செய்து கொண்ட சம்பவம், இந்திய சட்டங்கள் குறித்தும், குறிப்பாக பேஸ்புக் குறித்தும் பல்வேறு பிரச்னைகளை, கேள்விகளை,சந்தேகங்களை எழுப்பியுள்ளது.


இந்த போலியான பேஸ்புக் கணக்கை முடக்கவும், குற்றவாளியை கைது செய்யவும், காவல்துறை ஏன் உடனடி நடவடிக்கை எடுக்கவில்லை என்ற கேள்வி எழுந்தது. இவ்வாறான பேஸ்புக் கணக்கை முடக்கவோ, நீக்கவோ, காவல் துறையால் முடியாது; பேஸ்புக் நிறுவனம் மட்டுமே அதை செய்ய முடியும். பேஸ்புக், நாட்டின் சட்டங்களின் அடிப்படையில் அல்லாமல் சமூக வரையறை அடிப்படையில், அந்நிறுவனம் தான் இந்த நடவடிக்கை எடுக்க முடியும். இதுபோன்று ஆபாச புகைப்படம் அல்லது வேறொருவருடைய தகவல்களை திருடியதாக புகார் கொடுத்த பின்பும், குறிப்பிட்ட பேஸ்புக் கணக்கை முடக்க, காவல்துறைக்கு எந்த சிறப்பு அதிகாரத்தையும்


அந்நிறுவனம் அளிப்பதில்லை. இந்திய சட்டங்களுக்கு எதிரானதாக இருந்தாலும் இதுபோன்ற சம்பவங்களில், பேஸ்புக் கணக்கை பார்ப்பதற்கோ, அதை தடுப்பதற்கோ, விசாரிக்கவோ, இதுவரை பேஸ்புக்கில், காவல் துறைக்கு என தனியாக எந்த வசதியும் இல்லை.


அவ்வாறு காவல்துறை புகார் கொடுத்தாலும், பேஸ்புக் வரையறையின் அடிப்படையில் எந்த விதிமீறலும் இல்லை என, பேஸ்புக் முடிவு செய்துவிட்டால், காவல்துறையால் எதுவும் செய்ய முடியாது. அவசர காலத்தில், தொடர்பு கொண்டு நிலைமை குறித்து விவரித்து தகவல்களை பெறுவதற்கு, பேஸ்புக் சார்பில் எந்த அதிகாரியோ, தொலைபேசி எண்களோ கிடையாது.

Except for, perhaps, metros, most of the police may not have the know-how as to deal with internet crime.

When IT came in big time to india and banks started to adopt it in a big way, a special IT audit was made mandatory. Banks were required to have certain personnel to oversee the IT department.

I feel that the police department should have a nation wide uniform department that develops applications for the force, tracks internet and other IT crimes, maintains database and performs intelligence and counter-intelligence activities. I am unaware if there is a similar setup already in place.

In Tamil Nadu State, we have a specialised wing in Police Department called 'Cyber Crime Cell' to deal with prevention and detection of crimes relating to Information Technology Act, having jurisdiction over entire State and are manned by well trained staff and dedicated Officers.

Currently they also deal with the following cases:

1. Internet Password Thefts
2. Threatening e-mails
3. Cyber Stalking
4. Child Abuse/ Pornography
5. Economic Offences
6. Credit Card Number Theft
7. Denial of service attacks
8. Web page Hacking
9. Domain name disputes/ IPR disputes

I was recently in a conference on Cyber laws...Our IT Act 2000 & the subsequent amendment in 2008 deals with various issues relating to IT Industry, facilitate e governance and prevent cyber crime..The owner of IP address is responsible for the content accessed & distributed through it...We have seen many cyber crimes recently including the social media (Facebook, Twitter & bulk messages) rumor mongering that led to mass exodus of North East people from Bengaluru & other cities
