http://news.oneindia.in/2013/03/11/accused-italian-marines-not-to-return-1169280.html

Rome, March 11: The two Italian naval guards accused of shooting two Indian fishermen dead while on anti-piracy patrolling in February last year will not return for trial from a special home visit which was allowed to enable them to vote in the general election in their own country. The Italian foreign ministry informed this on Monday. The two marines shot the two Indian fishermen after mistaking them for pirates off Kerala. The ministry added that New Delhi did not respond to Rome's requests to seek a diplomatic solution to the case and the two countries witnessed a formal dispute between them over the terms of the UN Convention of the Law of the Sea of 1982.Italy claimed the incident occurred in international waters and has been trying to get the two marines tried in Italian courts, while India contends the shooting occurred in its own territory.

It was because of this that Rome formally confirmed to New Delhi, with a note verbale given by Ambassador Mancini, its willingness to reach an agreement on a solution of the dispute through the process of international arbitration or judicial settlement.Rome said given the formal establishment of an international dispute between the two countries, the duo, Marina Maximilian Latorre and Savior Pool will not return to India at the end of the permission granted to them. The Indian Embassy in Rome was intimated about the decision, which was taken in consultation with the defence and justice ministries in coordination with the office of the prime ministers. The ministry of external affairs later confirmed that it had received the intimation

And the assurances given by the italian embassy to the supreme court are just eyewash; I am sure this has been done with the full prior knowledge of the indian government.

Italians can get anything from india - orders, favours and the lot.

hi
except POPE from india......they get everything.....

The GOI was between the devil & the deep sea, so to say, right from the beginning of this case. On one side was the fishermen community, mostly Christian and united - a powerful vote bank which could swing to CPM, if displeased with the Congress in Kerala, and on the other was the Italian interests which, as all of you know, are more important for India than its own. Hence all this drama. Now, of course, the Congress in Kerala can paint the Italian Government as the villain.

But the Kerala fisherfolk are also educated and it will depend on what their priesthood will say to them. Hence we may get one more Cardinal from Kerala in the near future!

Slamming Italy for its refusal to send back the two marines charged in the fishermen killing case, Congress president Sonia Gandhi on Tuesday asserted that no country will be allowed to take India for granted.
"The defiance of the Italian government on the question of the two marines and its betrayal of a commitment to our Supreme Court is outright unacceptable," Gandhi said, addressing a meeting of the Congress Parliamentary Party here.
"No country can, should, or will be allowed to take India for granted. All means must be pursued to ensure that the commitment made by the Italian government to our Supreme Court is honoured," Gandhi said in four-page speech at the CPP.
After withholding posting of its ambassador-designate Basant Kumar Gupta to Rome, government had yesterday said further steps will be taken after completion of the review of bilateral ties with Italy.
Taking a tough stand, Prime Minister Manmohan Singh had accused Italy of violating "every rule of diplomatic discourse" and asked it to send back the two marines undergoing trial for killing Indian fishermen, failing which there will be consequences on bilateral ties.
The marines --Massimiliano Lattore and Salvatore Girone- charged with homicide for killing two fishermen off the Kerala coast in February last year in an anti-piracy operation, were permitted by the apex court on February 22 to go to Italy for four weeks for voting in election.

I am the PM of Italy:

1. There is a treaty being hammered out quietly in the sidelines by the countries of the world which involves an agreement to transfer all those who are serving prison sentences in the various countries to their respective mother countries to complete the sentence there. The agreement on this treaty may be reached soon. India and Italy are going to be parties to this international treaty.

2. India is a country with substantial forex reserves and a long shopping list of armaments (from pistol to field guns, from helicopter gunships to sophisticated drones and their control systems). Even a 10% of that would keep my country's armament factories running for the next 10 years with their order book full.

3. Indian prisons are not such horrible places for foreigners, particularly the white-skinned variety, say like the Changi or Guandanamo. With Lira's/Euro's value versus Indian Rupee being what it is it wont be very difficult to buy even some exciting pleasures as the prison managers are pliable there.

4. If I allow this controversy to simmer it may make life uncomfortable for powerful friendly individuals like Ottavio and his niece in India.

It is just a win-win situation if I send the prisoners back to India and get them back to the cool comforts of home later. So Mr. Nancini dont worry. The prisoner soldiers will be sent back.

Cheers.

It seems, so far 500 tamil fishermen are killed by srilankan navy. They even get spiritual favors- Govinda dharshanam and free laddus.

Possible only because tirupathy is in andhra. Soon the high commission in chennai will be closed; may shift to a neighbouring state.

A huge vishnu temple is coming up in sri lanka; future visits to india may not be necessary.

Indian government and the indian navy are fully aware that tamil fishermen fish in srilankan waters crossing the international border and practice seabed fishing which is banned by srilanka.

Other nationals irrespective of their status or occupation have the blessings of secular india to enter and pursue their ambitions and goals. It is not our fault when other countries do not reciprocate our noble ideals.

But, it is our fault, if they shot our people, without notices to our government for every violation! Our Govt. should demand details of every encounter, before any action is taken.

When indian navy makes its mission to stay away from the area when srilankan navy is patrolling, it must mean something. There is one shooting for every hundred arrests. Arrested fishermen are released after some noise; fishing gear is confiscated and destroyed, but no clamour for compensation from the fishermen; somebody must be making up the losses.

Anyway, jayalalitha has said that she will try get back katchatheevu legally.

But, it is our fault, if they shot our people, without notices to our government for every violation! Our Govt. should demand details of every encounter, before any action is taken.

Communal discrmination is the new secular mantra!

Minority scholarships: SC refuses to stay high court order - The Times of India

The Supreme Cour on Monday refused to stay Gujarat high court's (HC) order directing the Narendra Modi government to implement the Centre's scheme for pre-matriculation scholarships to students belonging to five religious minorities.
The central government's scheme was not implemented by the Gujarat government on the ground that it was in violation of the secular values enshrined in the Constitution. But a five-judge bench of the HC had concluded that the Centre's scheme was valid. Following this, students whose family income was below Rs 1 lakh were to get the scholarships. As per the state government's estimate, there are around six lakh students from Muslim, Sikh, Christian, Parsi and Buddhist communities eligible for the scholarship.

After the HC order earlier this year, the state government was legally bound to pay each student the scholarship amount, which as per the 2008 Union government scheme, comes to around Rs 850 per annum. But the state government decided to challenge the HC decision before the apex court.

Rejecting the state government's request to stay the HC order, the bench of Justice P Satashivam and Justice M Y Eqbal issued notices to the parties involved in the case. The court has kept further hearing of the case in August, said advocate Ejaz Maqbool who is representing the Islamic Relief Committe in the case.

Earlier, the matter had reached the HC after TOI reported that the Narendra Modi government was denying minority students the benefits of the scheme. Advocate Hashim Qureshi filed a PIL which was rejected by a division bench of the HC. However, as the view of the bench contradicted the 2009 order of another division bench of the same court, the matter was referred to a five-judge bench. This bench concluded that the scheme was legal and the state government had to implement it.

Hindutva is the only party that opposes such communal discrimination. Every other party deemed secular by intellectuals support it!
